4. ADDITIONAL TERMS & CONDITIONS

 

 

(i)

AUTHORITY:

The individuals signing this agreement, either personally or in a representative capacity, acknowledge their authority to do so

(ii)

 OBLIGATIONS In the event of any unforeseeable natural or human event (including incapacitating illness of the ARTIST) over which the parties have no control and as a consequence of which the performance by the ARTIST is rendered impossible, the parties shall be discharged of their obligations under this agreement.

(iii)

ACCEPTANCE

PART 2 - TERMS & CONDITIONS

The ARTIST warrants that it will diligently and conscientiously perform the engagement specified in this agreement.

GENERAL CONDITIONS FOR THE CONDUCT OF THE ENGAGEMENT:

The CLIENT and the ARTIST agree that the CLIENT has made the following arrangements:

  1. The ARTIST shall have artistic control of the performance and the personnel comprising the ARTIST
  2. The ARTIST is not required to commence before the specified starting time or to play on after the finishing time.
  3. The CLIENT shall provide timely and adequate access for the ARTIST to load equipment in and out of the venue.
  4. The CLIENT shall inform the artist before the commencement of the engagement what pattern of performance and breaks shall apply to the engagement provided that the ARTIST shall be entitled to a rest break of not less than ten minutes in each hour. When no notice is given the ARTIST shall at its discretion apply music industry custom and practice for that particular type of engagement.
  5. If the performance is delayed, interrupted or finishes early because of failure by the CLIENT to comply with the terms of this agreement or for any reason attributable to the CLIENT, the performance fee will be paid notwithstanding any such delay, interruption or early finish.
  6. If the CLIENT is required to provide accommodation in accordance with clause 1 of PART 1 of this agreement, it shall be at least motel style. Should no accommodation provision be specified by Clause 1 of PART 1, the parties agree that the accommodation costs of the ARTIST are deemed to be included in the performance fee.
  7. The CLIENT will supply safe working conditions and adequate security for the ARTIST their instruments, and equipment and a sheltered area for the conduct of the performance to protect the ARTIST from direct sun or inclement weather.
  8. If normal scheme power services are not available the CLIENT will provide safe and adequate power supplies operated by qualified persons and will indemnify the ARTIST against loss or damage to instruments and equipment arising from any malfunction thereof.
